Terms of Service

These Terms of Service ("Terms") govern your use of the This vs That web application. By accessing or using the application, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the application.

2. User Accounts

  • Registration: While you may participate in public voting without an account, you must create an account using Google Login to track your personal statistics and appear on leaderboards.
  • Responsibility: You are responsible for maintaining the security of your Google account. We are not liable for any loss or damage arising from unauthorized access to your account.
  • Account Termination: We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violating these Terms or engaging in abusive behavior (e.g., using bots to manipulate vote counts).

3. Acceptable Use

You agree to use the application only for its intended purpose—voting on and ranking entertainment items. You agree not to:

  • Use automated scripts, bots, or unauthorized software to rapidly cast votes or manipulate item rankings.
  • Attempt to reverse-engineer, decompile, or hack the application.
  • Impersonate other users or employees of the application.

4. User-Generated Content & Voting Data

By casting votes in the application, you grant This vs That a non-exclusive, royalty-free, perpetual right to use, display, and aggregate that voting data to form public leaderboards, item rankings, and community statistics.

5. Intellectual Property

The initial images, movie data, and game titles displayed in This vs That are the property of their respective copyright holders (e.g., IGDB, TMDB) and are used under fair use or applicable API terms for the purpose of commentary and public ranking.

The original code, branding (including the "This vs That" logo), and unique UI design belong to the developers of the application.

6. Disclaimer of Warranties

The application is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or uninterrupted performance of the application. We do not guarantee that the voting results are scientific or definitively accurate.

7. Limitation of Liability

To the maximum extent permitted by law, This vs That and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application.

8. Third-Party Data & API Attribution

This application uses data and media assets provided by third-party APIs, including:

  • TMDb
  • TheSportsDB
  • AniList
  • IGDB
  • SuperHeroAPI

This product uses the TMDb API but is not endorsed or certified by TMDb.

All trademarks, logos, names, titles, character names, athlete names, team names, images, game artwork, superhero likenesses, and related intellectual property remain the property of their respective owners.

  • Video game-related data and images may be sourced via IGDB.
  • Superhero-related data may be sourced via SuperHeroAPI.
  • Anime-related data may be sourced via AniList.
  • Sports-related data may be sourced via TheSportsDB.

Use of such data and media is subject to the respective API providers’ terms of service and applicable intellectual property laws.

This application is an independent, fan-created project and is not affiliated with, endorsed by, sponsored by, or approved by any studios, publishers, production companies, sports leagues, teams, athletes, celebrities, comic publishers, licensors, or rights holders.

9. Ranking & ELO System Disclaimer

Item rankings and leaderboards within the application are generated algorithmically using user voting data (including ELO-based calculations).

Rankings reflect aggregated user interaction and do not represent official ratings, factual evaluations, endorsements, or objective determinations of quality.

All rankings are provided solely for entertainment purposes.

10. Public Leaderboards & Visibility

By creating an account and participating in voting, you acknowledge that your Display Name / Username, Profile Picture, Country Flag, vote totals, and ranking statistics may be publicly visible within leaderboards and shared profile links.

You retain the right to request account deletion as outlined in the Privacy Policy.

11. Advertising

The application may display advertisements provided by third-party advertising networks, including Google Ads.

We are not responsible for the content of third-party advertisements or any external websites linked from advertisements displayed within the application.

12. Copyright & Intellectual Property Complaints

We respect the intellectual property rights of others.

If you believe that any content within the application infringes your copyright or trademark rights, please submit a written notice to info@thespacemonkey.co.za including sufficient information to identify the material in question.

We will review and, where appropriate, remove or disable access to the allegedly infringing content.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.

The application may be hosted within the European Union. Nothing in these Terms limits any mandatory rights afforded to users under applicable consumer or data protection laws.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes, but your continued use of the application constitutes acceptance of the modified Terms.
